Can You Buy a Car That Is Still on Lease?

A leased car belongs to the leasing company, not the person selling it. Buy one by mistake and you can lose the car and every penny you paid.

The car is a year old, immaculate and a few thousand pounds under the going rate. The seller says they are emigrating and need it gone this week. The question nobody asks is whether they are allowed to sell it at all. Can you buy a car that is still on lease? Not legally, and if you do it by accident the car can be taken back from you.

Leasing has become the normal way to get a new car in the UK. Hundreds of thousands of drivers are behind the wheel of a car they will never own. A small number of them try to sell it anyway.

Why You Cannot Buy a Car That Is Still on Lease

A lease, sold as personal contract hire or business contract hire, is long term rental. The leasing company buys the car, the driver pays a monthly fee to use it, and at the end of the term the car goes back. There is no balloon payment and no option to buy. At no point does the driver own it.

That matters because you cannot be given ownership by someone who does not have it. If a lessee sells you the car, the leasing company still owns it. When they trace it, and they usually do, they can recover it. Your money went to the seller, not to them.

This is different from buying a car with outstanding finance. Hire purchase cars carry some protection for private buyers who acted in good faith. A lease is not a hire purchase agreement, so that safety net does not apply. Our guide on buying a car with outstanding finance covers the hire purchase side.

How to Tell if a Car Is Leased

Read the V5C properly

The logbook shows the registered keeper. On a leased car this is often the leasing company, a contract hire firm or a dealer group's leasing arm. If the name on the V5C is a company and the seller is a private individual, you need a very good explanation before going any further.

Keeper and owner are not the same thing in law, as our guide to what a car keeper is explains. But a company keeper on a car being sold privately is the clearest single warning sign there is.

Watch for the pattern

Leased cars being sold illegally tend to look alike:

  • under three years old, often under two
  • low mileage for the age
  • high spec, because lease deals make premium models cheap per month
  • a seller who wants cash or a bank transfer quickly
  • a story about moving abroad, a job ending or a relationship breakdown

None of these prove anything alone. Together they should slow you right down.

Ask direct questions

Ask the seller how they bought the car and from whom. Ask to see the purchase invoice or the finance settlement letter. A genuine owner of a nearly new car has paperwork showing they paid for it. Someone leasing it has a lease agreement, and they will usually avoid showing it.

What a History Check Shows on Leased Cars

Most major leasing and contract hire companies record their agreements on the same databases lenders use. The Full Report includes the recorded finance check, so an active agreement against the car will usually show up.

Usually is not always. Smaller firms and some business leases are not always registered. That is why the V5C and the paperwork matter as much as the data check. Use both.

If You Have Already Bought a Leased Car

Act quickly:

  1. Contact the leasing company named on the V5C or any paperwork. Explain what happened.
  2. Report the seller to the police. Selling a car you do not own is fraud.
  3. Contact your bank. If you paid by card or bank transfer recently, ask about recovery.
  4. Keep every message, advert screenshot and receipt.

Some leasing companies will deal with innocent buyers sensibly, but they are under no obligation to let you keep the car.

Leased Cars Sold Through Dealers

Leased cars do come back onto the used market legitimately. At the end of the term they go to auction or to dealers, who sell them with clean title. These are the ex-lease cars covered in our guide to buying an ex-fleet or lease car. The difference is who is selling. A trader selling an ex-lease car has bought it from the leasing company. A private seller with a car still on lease has not.

FAQ

Can someone sell me a car they are leasing?

Not legally. On a personal or business lease the leasing company owns the car for the whole term and the driver never gets the option to buy it outright. A lessee who sells the car is selling something they do not own, and the leasing company can take it back from you.

How can I tell if a car is leased?

Look at the V5C. On most leased cars the registered keeper is the leasing or contract hire company, not the person in front of you. Brand new cars with very low mileage, a young plate and a seller who wants a quick cash sale are a pattern worth questioning.

Is a leased car the same as a car on finance?

No. With hire purchase or PCP the driver can end up owning the car once the agreement is settled. With a lease, also called contract hire, the car goes back at the end and ownership never passes to the driver.

What happens if I have already bought a leased car?

Stop using it as if it is yours and contact the leasing company named on the paperwork. Report the seller to the police as a fraud. Private buyers have some protection with hire purchase cars under the Hire Purchase Act, but a lease is not hire purchase, so do not count on keeping it.

Will a history check show a lease?

Many leasing companies register their agreements on the same databases used for finance checks, and a Full Report at £9.99 shows recorded finance and agreements. Not every lease is recorded, so always check the keeper on the V5C as well.
